Jimmy_FlyntCINCINNATI, Ohio – The brothers Flynt are headed to court. Jimmy Flynt, 51, is suing his older brother, Larry, accusing the porn magnate of literally trying to force him out of the family business by evicting him from a building in Cincinnati that houses the Downtown Hustler Store, which he owns and operates.

The suit alleges that the attempted eviction, rather than a legitimate dispute over rent, is really in retaliation for Larry’s other legal dispute with Jimmy Sr’s sons, Dustin and Jimmy II, who started an adult production company called Flynt Media Corp., prompting a trademark lawsuit against them by their uncle.

Jimmy Sr., leases space from Elm 411 LLC, one of his brother’s companies. According to Cincinnati.com, “The suit accuses Larry Flynt of falsely accusing Jimmy Flynt of being late on the rent for the Cincinnati Hustler store.”

According to the 13-page complaint, however, Jimmy Flynt (pictured) says he recently paid over $30,000 in back rent, even though the accuracy of the amount Elm 411 claims he owes, as well as the methodology used by the landlord to come up with the amount, are disputed in detail.

Despite that payment, the complaint alleges that Larry began eviction proceedings in a malicious attempt to “interfere with Jimmy Flynt, Sr’s livelihood and… cause financial hardship due to Jimmy’s inability to ‘control his boys,’ due to Jimmy’s unwillingness and inablity to interfere with his son’s business or contractual affairs, and due to Jimmy’s inability to create an advantage for Larry with respect to his pending legal dispute(s) with Dustin and Jimmy II [Flynt]. Larry has followed through on his threats against his brother, in part, by attempting to evict Plaintiff from the Hustler Cincinnati store at 411 Elm St.”

The suit further alleges that the attempted eviction is in relatiation for Jimmy Sr’s refusal to loan Larry Flynt Productions $400,000 in May. “Plaintiff submits that LFP’s loan request was part of Larry Flynt’s attempt to cause economic hardship to Jimmy Flynt by draining all of Plaintiff’s cash on hand.”

The lawsuit is Hustler Cincinnati v. Elm 411.
