StockingsWebSAN DIEGO, Calif. – The Federal Aviation Administration has sent one San Diego helicopter pilot a loud-and-clear message: Choppers and penises shouldn’t be up at the same time.

The FAA revoked David Martz’s pilot’s license March 11 after the gossip website TMZ posted a clip of Martz and a porn starlet “getting it on” in the skies over San Diego. Martz’s undivided attention should have been on the controls of the helicopter he was flying at the time, the FAA said.

The clip was filmed in 2007, according to TMZ. The FAA’s action marked the fifth time Martz’s license has been suspended or revoked for behavior the FAA believes could endanger public safety.

In 2006, he was charged with “reckless flying” after landing a helicopter on a public street in the Hollywood Hills in order to pick up notorious bad-boy rocker Tommy Lee and fly him to a concert.

“These actions showed a careless and reckless disregard for safety and showed that he lacks the care, judgment and responsibility to hold a commercial pilot certificate,” FAA spokesman Ian Gregor told San Diego’s Union-Tribune newspaper.

Martz is appealing the action, according to the Union-Tribune. An administrative law judge is expected to rule on the revocation within 30 days.
